By downloading, installing or using the Application and/or the Services, you signify your agreement to be bound by the Terms. Your continued use of the Application and/or the Services offered through the Application will imply your acceptance of the conditions contained under these Terms.
These Terms constitute an 'electronic record' within the meaning of the applicable law (including the Information Technology Act, 2000) and is generated by a computer system and does not require any physical or digital signatures.
Please read these Terms carefully before you use the Application or any Service offered by hike through the Application. These terms control the relationship between hike and you. They do not create any third party beneficiary rights.
1. Application; Your Account
Application: The Application is an online platform which enables you to engage in peer-to-peer (P2P) interaction with other users and avail Services made available to you by hike through the Application. Hike may at its discretion allow you to use some of these Services free of charge. Our Services are very diverse and additional terms or product requirements may apply to certain Services. These additional terms are made a part of these Terms by this reference. If there is a conflict between these terms and the additional terms, the additional terms will supercede these terms.
Services shall include, but not be limited to, Social and Sharing Services, Platform Services and Hike Wallet Services. More information about the Application and the Services is available on hike’s website at www.hike.in ("Site").
Your Account: You can access the Application and the Services by creating an account on the Application using your mobile device. By using the Application, you agree to ensure confidentiality of your account, password credentials and for limiting access to your mobile device to prevent unauthorized use of your account on the Application. You will be responsible for any activity under your account or password and for informing us immediately if you have any reason to believe that your password is likely to be used in an unauthorized manner. Please ensure that the details you provide us are accurate and complete and inform us immediately of any changes to the information that you provided when signing-up.
Your Access to the Application: We will endeavor to ensure error-free availability of the Application or Services or contents thereof to you, however your access to the Application may occasionally be suspended or restricted for repairs, maintenance, or updating the Application at any time without prior notice. We will try to limit the frequency and duration of any such suspension or restriction.
You are responsible for any mobile charges that you may incur by accessing the Application or Services made available through the Application, including text-messaging and data charges. If you're unsure what those charges may be, you should ask your service provider before using the Application or the Services.
2. License; Third Party Content
Subject to these Terms, hike grants you a limited, personal, non-assignable, non-transferable, non-exclusive, revocable, and non-sublicensable license to use and/or access the Application or Services (including the content made available through the Application or Services) provided that: (a) you will use the Application and/or Services solely for lawful purposes only; (b) you will not, nor allow third parties on your behalf to reproduce, reverse engineer, duplicate, copy, sell, create derivative works or otherwise exploit for any commercial purpose the Application (including its content) and/ or Services; (c) you will not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including without limitation images, text, page layout, or form); and (c) you will not use any meta-tags or any other 'hidden text' utilizing hike's name or trademarks. Any unauthorized use of the Application and/or Services terminates the permission or revokes the license granted herein.
Certain content or services made available through the Application or the Services may have been created, published, provided or shared by other users, publishers, and other third parties ("Third Party Content/ Services"). Whether that Third Party Content/Services is the sole responsibility of the person who published / submitted/ provided the Third Party Content/Services. By using the Application and/ or Services, you agree that the hike or its affiliates will not be responsible/ liable for any such Third Party Content/Services in any manner whatsoever. You will not, nor allow third parties on your behalf to reproduce, duplicate, copy, sell, create derivative works or otherwise exploit for any commercial or other purpose any Third Party Content/Services. You will not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including without limitation images, text, page layout, or form). Hike does not guarantee the validity, fitness for a particular purpose, veracity, accuracy or legal status or confidentiality with respect to the Third Party Content/Services.
3. Your Content
The Application or Services may allow you to create, upload, share and/ or store content, including but not limited to photos, profiles (including your name, images and voice),stories, messages, information, text, video, music, third party links and automatic submission of your ‘last seen’ time (collectively, "Content")
By posting your Content through the Application or the Services, you grant hike and our affiliates, a worldwide, non-exclusive, royalty-free, irrevocable, sub-licensable and transferable license to use, copy, reformat, modify, translate, create derivative works, display, sell and distribute such Content for or in connection with the use of the Application or Services. In the event you or any other person appears in any Content submitted to hike by you, you grant hike an unrestricted, worldwide right and license to use your name, likeness, and voice. This means, among other things, that you will not be entitled to any compensation from hike or our affiliates if your name, likeness, or voice is conveyed through the Application or Services. In addition to granting us the aforementioned rights, you also grant us a perpetual license to create derivative works from, promote, exhibit, broadcast, syndicate, sublicense, publicly perform, and publicly display Content posted by you in any form and in any and all media or distribution methods (now known or later developed).
Hike does not assert any ownership over the Content and subject to the rights granted to hike in these Terms, you retain full ownership of the Content and proprietary rights associated with the Content.
You will be solely responsible for all Content that you upload, transmit, share or display through the Application or Services. Hike does not guarantee the validity, accuracy or legal status or confidentiality with respect to any Content and you will be solely responsible to assume all risks for any consequences arising out of uploading, posting, broadcast, transfer or disclosure of the Content. You confirm and warrant that the Content does not violate the representation and warranties you provide under these Terms.
You agree and acknowledge that if you transmit any Content through the Application, you have permission from the rightful owner of the Content or you are otherwise legally entitled to use or transmit the Content and to grant hike and our affiliates all of the license rights granted herein.
Subject to applicable laws, upon deletion of the hike account, hike will delete all your Content from its database and servers within a maximum of 30 days, except to the extent required to be retained by applicable law. For the avoidance of doubt, it is clarified that any part of your Content (viz. your messages, status updates, profile picture updates, materials / files shared by you) stored by your contacts/ friends locally on their device may remain even after you delete your account till it is deleted by such contacts. Similarly, any part of your Content, which is publicly available to other users of hike who have you in their list of contacts (i.e. the content included in the image uploaded by you and the associated time stamp) stored by your contacts may remain after you delete your account till it is deleted by such contacts. The submission of your 'last seen' time is done on an automatic basis.
You acknowledge and agree that the Application, the Services, including without limitation any content available on the Application and all trademarks, service marks and trade names and other intellectual property rights associated therewith are, and will remain, the property of hike and its licensors, as applicable. All content related to hike corporate and business activities embedded in the Application, including any text, graphics, logos, button icons, images, audio clips and software, is the exclusive property of hike or its licensors and is protected by applicable laws. The compilation (meaning the collection, arrangement and assembly) of any and all content on the Application and Services is also the exclusive property of the hike and is protected by applicable laws.
All software used on the Application and the Services is the property of hike or its licensors / software suppliers and protected by Indian and international copyright laws. Any use except as specifically permitted under these Terms, including the reproduction, modification, distribution, transmission, republication, display or performance, of the content on the Application or the Services is strictly prohibited.
All hike graphics, logos and service names are trademarks of the hike or its affiliates. Hike’s trademarks should not be used in connection with any product or service that is not hike's, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits hike. The logos and trademarks of third parties on the Application belong to respective third parties / brands and hike has no connection whatsoever with such third parties / brands.
6. Your Conduct
(a) You shall be solely responsible for all contents that You upload, transmit, share or display through the Application or the Site, (collectively the “Contents”) including but not limited to any photos, profiles (including Your name and image), messages, information, text, video, music, third party links and automatic submission of your ‘last seen’ time. hike does not guarantee as to the validity, accuracy or legal status or confidentiality with respect to any Contents and You shall be solely responsible and assume all risks for any consequences of uploading, posting, transfer or disclosure of the Contents. You hereby confirm and warrant that the Contents do not violate the representation and warranties provided in Clause 5 above. You further agree that Content you transmit over the Application will not contain third party copyrighted material, or material that is subject to other third party proprietary rights, unless you have permission from the rightful owner of the material or you are otherwise legally entitled to use or transmit the material and to grant hike all of the license rights granted herein.
You represent and warrant that: (i) your use of the Application or the Services will be solely for purposes that are permitted by these Terms; (iii) you will provide true and accurate information (including your mobile phone number and other numbers in your address book) for use of the Application or the Services; (iv) your use of the Application or the Services will at all times comply with applicable laws.
You must not use the Application or the Services for fraudulent purposes or in connection with a criminal offense or other unlawful activity or to send, post, share, use or reuse any material that does not belong to you or that you are not authorized to send; or is illegal, offensive (including but not limited to material that is sexually explicit content or which promotes racism, bigotry, hatred or physical harm), deceptive, misleading, abusive, indecent, harassing, blasphemous, defamatory, libelous, obscene, pornographic, pedophilic or menacing; ethnically objectionable, disparaging or in breach of copyright, trademark, confidentiality, privacy or any other proprietary information or right; or is otherwise injurious to third parties; or relates to or promotes money laundering or gambling; or is harmful to minors in any way; or impersonates another person; or threatens the unity, integrity, security or sovereignty of India or friendly relations with foreign States; or objectionable or otherwise unlawful in any manner whatsoever; or which consists of or contains software viruses, political campaigning, commercial solicitation, chain letters, mass mailings or any spam to cause annoyance, inconvenience or needless anxiety.
Hike reserves the right at any time and from time to time to interrupt, restrict, modify or discontinue, temporarily or permanently, Application (or any part thereof) or any Services without any cause and/or without any notice to you. You agree that hike and it’s affiliates will not be liable to you or to any third party for any modification, suspension or discontinuance of the Application or Services.
8. Contests and Promotional Events
Hike may from time to time organize contests, draws or other such promotional events (“Events”). In order to be eligible for participation in such Events must be 18 years old or above and a citizen of the Republic of India. In the event that you are below 18 years old, your participation must be supervised by your parents or legal guardian. Hike’s employees, affiliates or agents or any entity directly involved in the development or administration of any Event, and the members of their immediate families (defined as spouse, parents, siblings, children, grandchildren, including "in-laws" of each) are not eligible to participate in such Events.
Participants who win such Events shall be notified, either by a notification in the Application, SMS or phone call. Winners who are not reachable/contactable for five (5) consecutive working days shall be automatically disqualified and we shall draw an additional winner to substitute the disqualified winner.
Any rewards to which winners may be entitled to, shall be given on ‘as is’ basis and without warranty of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose) will not be exchangeable, replaceable or returnable under any circumstance whatsoever. Hike reserves its right to substitute such rewards with rewards of equal or greater value. In the event that a winner incurs any tax liability with respect to the rewards, such tax is the sole responsibility of the winner.
Winners shall be required to provide a valid identification card with photo prior to claiming their reward. In the event a winning participant is below 18 years old their parent or legal guardian will be required to provide a valid identification card and sign a consent form for the participant to be able to claim their reward. In the event that the winning participant fails to provide a valid identification card or a signed consent letter and a valid identification card within 30 days of first contact by us, the participant shall be automatically disqualified and we shall draw an additional winner to substitute the disqualified winner.
Hike reserves the right to withdraw or discontinue any Event at any stage without incurring any liability whatsoever. Hike’s decisions on all matters pertaining to such Events will be final and binding.
9. Disclaimer of Warranties
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOUR USE OF THE APPLICATION OR SERVICES IS AT YOUR SOLE RISK AND DISCRETION. THE APPLICATION IS LICENSED TO YOU "AS-IS," "WITH ALL FAULTS," AND "AS AVAILABLE." YOU BEAR THE RISK OF USING IT. HIKE AND/ OR ITS AFFILIATES GIVES NO EXPRESS WARRANTIES, GUARANTEES, OR CONDITIONS UNDER OR IN RELATION TO THE APPLICATION OR SERVICES. HIKE AND/ OR ITS AFFILIATES EXCLUDE ANY IMPLIED WARRANTIES OR CONDITIONS, INCLUDING THOSE OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON- INFRINGEMENT.
HIKE MAKES NO WARRANTY AGAINST AND WILL NOT LIABLE OR RESPONSIBLE FOR: (A) INTERFERENCE OF YOUR ENJOYMENT OF THE APPLICATION OR SERVICES; (B) LOSSES OR DAMAGES INCLUDING ANY PERSONAL INJURY ARISING FROM OR IN ANY WAY RELATED TO YOUR ACCESS OR USE OF THE APPLICATION AND/ OR SERVICES; (C) USE OF ANY CONTENT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE APPLICATION AND/ OR SERVICES; (D) FAILURE, SUSPENSION OR WITHDRAWAL OF ALL OR PART OF THE APPLICATION AND/ OR ANY SERVICE AT ANY TIME; (E) ANY BUGS, VIRUSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH OUR APPLICATION OR SERVICES; (F) FUNCTIONAL, UNINTERRUPTED, ERROR-FREE OR BUG-FREE DELIVERY OF THE APPLICATION AND/ OR SERVICES; (G) SECURITY, RELIABILITY OR TIMELINESS OF THE APPLICATION AND/ OR SERVICES. ANY CONTENT OR MATERIAL DOWNLOADED THROUGH YOUR USE OF THE APPLICATION AND/ OR SERVICES IS AT YOUR OWN DISCRETION AND RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE OR LOSS OF DATA OCCURRING ON YOUR DEVICE OR ANY OTHER LOSS OR DAMAGES OF ANY KIND RESULTING FROM THE DOWNLOAD AND USE OF THE APPLICATION AND/ OR SERVICES. NO ADVICE, COURSE OF CONDUCT OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM HIKE OR ANY PARTY OR THROUGH THE APPLICATION/ OR SERVICES WILL CREATE ANY WARRANTY UNLESS EXPRESSLY STATED IN THESE TERMS.
WHILST HIKE WILL UNDERTAKE ALL REASONABLE EFFORTS AND DUE DILIGENCE TO ENSURE SECURITY AND INTEGRITY, HIKE WILL, IN PARTICULAR, NOT BE LIABLE FOR THE FOLLOWING: DELAY OR ERRORS IN TRANSMISSION AND/ OR STORAGE OF INFORMATION TO OR THROUGH HIKE THAT MIGHT OCCUR FROM TIME TO TIME INTRUSION, DISTORTION, LOSS OR FORGERY OF DATA, ETC DUE TO ACT OF ANY THIRD PARTY, FAILURE OF ANY SOFTWARE AND/OR HARDWARE OR TELECOMMUNICATION SERVICE PROVIDER(S) USED BY US OR ANY OTHER ACT BEYOND OUR REASONABLE CONTROL.
YOU WILL BE LIABLE FOR ANY CONSEQUENCES WHATSOEVER RESULTING FROM ANYTHING TRANSMITTED OR CAUSED TO BE TRANSMITTED BY YOU, TO OR THROUGH THE APPLICATION/ OR SERVICES.
WHILST HIKE SHALL UNDERTAKE ALL REASONABLE EFFORTS AND DUE DILIGENCE TO ENSURE SECURITY AND INTEGRITY, HIKE SHALL, IN PARTICULAR, NOT BE LIABLE FOR THE FOLLOWING: DELAY OR ERRORS IN TRANSMISSION AND/OR STORAGE OF INFORMATION TO OR THROUGH HIKE THAT MIGHT OCCUR FROM TIME TO TIME; INTRUSION, DISTORTION, LOSS OR FORGERY OF DATA, ETC DUE TO ACT OF ANY THIRD PARTY, FAILURE OF ANY SOFTWARE AND/OR HARDWARE OR TELECOMMUNICATION SERVICE PROVIDER(S) USED BY US OR ANY OTHER ACT BEYOND OUR REASONABLE CONTROL.
YOU SHALL BE LIABLE FOR ANY CONSEQUENCES WHATSOEVER RESULTING FROM ANYTHING TRANSMITTED OR CAUSED TO BE TRANSMITTED BY YOU, TO OR THROUGH THE APPLICATION.
10. Limitation of Liability
To the maximum extent permitted by applicable laws, under no circumstance will hike or its affiliates, their respective directors, employees or agents be liable to you or any third party for personal injury, or any special, incidental, indirect, punitive or consequential damages whatsoever, including, but not limited to, damages for loss of profits or revenues, goodwill, failure to transmit or receive any data, loss of confidential information, business interruption, loss of privacy, corruption or loss of data, failure to receive or backup your data (or archived data), for any cause of action, including contract, tort (including negligence) or otherwise and any other loss whatsoever arising out of or in any way arising from or related to the use of Application, or following a failure, suspension or withdrawal of all or part of the Application at any time, any third party content, software or functions used in connection with the Application even if hike or any or all of its agents have been advised of the possibility of such damages. Notwithstanding anything to the contrary, our maximum aggregate liability to you for any causes whatsoever, and regardless of the form of action (whether liability arises due to negligence or other tort, breach of contract, violation of statute, misrepresentation or for any other reason), will at all times be limited to the amount paid by you, if any, for using any Services giving rise to the cause of action or Rupees one thousand only (Rs. 1000), whichever is lesser.
You agree to indemnify, defend and hold harmless hike, its subsidiaries, affiliates and agents and each of their respective officers, directors, employees, successors and assigns from and against any claim, proceeding, loss, damage, liability, cost, demand or expense (including but not limited to attorney's fees) of any kind arising out of: (i) your access to or use of the Application and Services; (ii) any breach of these Terms; (iii) your violation of the rights of a third party, including but not limited to infringement of any intellectual property, proprietary right or trade secret of any person or entity, or of any privacy or consumer protection right that is implicated herein; (iv) any violation of law or contractual obligation and any claims, demands, notices pursuant to such violation; (v) your negligence or misconduct. These obligations will survive termination of these Terms
12. Force Majeure
Hike will not be liable to you for any eventuality caused directly or indirectly by any act of God, wars (declared or undeclared), insurrections, acts of terrorism, acts of governments or boycotts, lockouts and other civil unrest, or any act of similar nature beyond hike's reasonable control.
The Application and/or the Services should only be used or accessed by persons who are competent to enter into a legally binding contract under the Indian Contract, 1872. If you are a minor (i.e. you are under the age of 18 years), you may use the Application or Services only with the involvement of your parent or guardian.
Hike may communicate with you through e-mail, SMS, telephone, by posting notifications on the Application (including push notifications) or any other means of communication. By using the Application, you consent to receive such communications from hike in relation to the Application and/or Services, your account information or any updates/ changes to the Application/ Services and/ or other promotional or marketing communications from hike.
15. Amendments to this Agreement
Please review these terms regularly. We may in our sole discretion modify or amend these Terms from time to time without any prior notice. Your use of the Application or Services upon publication of such modified or amended terms will constitute your deemed acceptance to the modified or amended Terms.
16. Entire Agreement
If one or more provisions of these Terms are held to be unenforceable under applicable law(s), the remainder of these Terms will be valid and enforceable.
If you breach these Terms and hike takes no action, we will still be entitled to use our rights and remedies in any other situation where you breach these Terms.
19. Governing Law
These Terms are governed by the laws of India. You irrevocably consent to the exclusive jurisdiction of courts at Delhi, India for all disputes arising out of or relating to these Terms.
20. Grievance Officer
In the event you have any queries/complaints regarding usage of Application, please contact email@example.com. The complaints will be redressed in the manner provided under the Information Technology Act, 2000 and rules framed thereunder.
21. Right to Take down
You understand and agree that hike may takedown, delete or remove any content available on the Application in its sole discretion, without any notice to you, for any reason whatsoever including on account of your violation of these Terms or if required in accordance with applicable law (including but not limited to the Information Technology Act, 2000).
Your use of Hike’s Social and Sharing Services or any part of thereof, is governed by the following terms (“Social and Sharing Services Terms”) in addition to the Terms. Please review these Social and Sharing Services Terms before you access or use Hike’s Social and Sharing Services. Hike’s Social and Sharing Services include but are not limited to instant messaging services, audio and video calling, stories, live filters, etc.
If there is any conflict between the Terms and these Social and Sharing Services Terms, the Social and Sharing Services Terms shall prevail to the extent of such conflict. All terms used but not defined herein shall have the respective meanings assigned to them under the Terms.
You are responsible for all activity that occurs in your hike account. By using the Services, you agree that:
Additional Audio and Video Call Terms
You understand that hike does not provide calling or connections to telephone numbers and hike’s audio and video calling services can be used only within the closed hike network.
Video Call: You understand that when you use hike’s video calling feature to call other hike users, your live feed will be displayed on the receiver’s phone screen.
Emergency Calls: You understand and agree that the Service is not capable of placing or receiving emergency services calls.
hike to SMS
The hike to SMS feature permits you to send a message to other hike users who may be offline. For this purpose, you authorize hike to notify you if the user you are attempting to message is offline. You further authorize us to send your last posted message in the chat thread as an SMS to other user in the event that you click on the ‘Send as SMS’ button.
Your use of Hike’s Platform Services or any part of thereof, is governed by the following terms (“Platform Services Terms”) in addition to the Terms. Platform Services include but are not limited to News, Channels, Games, Hike Daily, Just for Laughs, Hike Run, Cricket, Third Party Content/Services or e-commerce services made available through the Application.
Any capitalized term which has not been defined in these Platform Services Terms shall have the meaning ascribed to them in the Hike’s Terms of Service.
If you believe in good faith that any content displayed or transmitted through the Application infringes your copyright, you may reach us at firstname.lastname@example.org
If you in good faith believe that any content made available through the Application is offensive or opposed to public policy you may choose to report any such content. We may, review such content and remove the content at our discretion and/or as mandated by applicable laws.
The platform may includes features that promote physical activity. Consider the risks involved and consult with your medical professional before engaging in any physical activity. Hike is not responsible or liable in any manner for any injuries or damages you may sustain that result from your use of, or inability to use, the features of the Hike Run.
Bill Payment Services:
1. Description of Bill Payment Service
Hike provides bill payment services that allow You to make payments to certain third parties (“Bill Payment Services”). To be eligible to use the Bill Payment Services, You must be a resident of the India. In order to use the Bill Payment Services, You may be required to provide us with your account information with billers you would like to make payments to (such as your customer account number or customer ID) and any information necessary for us to access Your accounts with such billers (such as phone number, email address, etc) ("Bill Payment Account Information"). By using the Bill Payment Services, You expressly authorize hike to store, use and access the Bill Payment Account Information, on Your behalf solely for the purpose of providing the Services to You. As a risk management measure, hike reserves the right not to process transactions which hike in its sole discretion determines to be high risk, suspicious or fraudulent in any manner.
You understand and agree that you are responsible for the accuracy of the information you provide with respect to each payment request you make, including the Bill Payment Account Information, telephone number, the amount of the transaction, etc.
2. Scheduling your payments
Payment posting times will vary depending upon the biller you select. When hike receives a payment instruction, You authorize us to send instructions to payment system providers to debit your card/ bank account/prepaid account/card and remit payments to billers on your behalf. Payments are subject to the policies and procedures of billers. We are not liable for processing delays by the biller, nor are We liable if You fail to schedule payment dates in a timely manner.
3. Late charges
You are solely responsible for paying any and all late charges and penalties levied by a biller.
4. Payment history
Hike does not send periodic statements showing Your bill payment history. You may access information about your bill payment requests using the Application. You should also confirm your bill payment requests against any statements or payment records provided by the biller and your payment source.
Hike Wallet Services
Hike Wallet is a service provided by Hike Private Limited and its partners, and is subject to the Hike Terms and these Hike Wallet Terms of Service.
Your use of the Hike Wallet Services or any part of thereof, requires that you agree to the following terms. Please review these Hike Wallet Terms of Service before you decide whether to accept them and access or use of Hike Wallet Services (as defined below). If you do not agree to these Hike Wallet Terms of Service or do not wish to be bound by them, you may not use the Hike Wallet Services.
If there is any conflict between the Terms and these Hike Wallet Terms of Service, the Hike Wallet Terms of Service shall prevail to the extent of such conflict. All terms used but not defined herein shall have the respective meanings assigned to them under the Terms.

In addition to the abovementioned payment instruments/services, we facilitate you to make use of your debit card, credit card, net banking and any other acceptable modes of payment mechanism provided by us or our partners.
You understand, acknowledge and agree that Hike is not a bank and the Hike Wallet Services should in no way be construed as the provision of banking services.
2. Registration and Use of Hike Wallet Services
In order to use the full suite of Hike Wallet Services, you need to register on the Application. Hike may require you to provide certain personal information, including Know Your Customer information/documents, at the time of registration for Hike Wallet Services and/or on a later date, for the purpose of due diligence and availing and/or continuing to avail Hike Wallet Services (“Due Diligence Documents/Information”). In the event that you have requested for issuance/availing of certain payment instruments/services forming part of Hike Wallet Services, we may share the Due Diligence Documents/Information provided by you with our partners for the purpose of compliance with Know Your Customer related laws, rules, regulations and directions issued by the Central Government or the Reserve Bank of India or any other regulatory authority.
You hereby authorize us, directly or through third parties, to make any inquiries that we may consider necessary to validate and/or authenticate your identity for the purpose of provision or continued provision of Hike Wallet Services to you.
You shall ensure that all information provided by you to Hike will be accurate and complete at all times. In the event that Hike or its partners determine that the information provided by you incorrect and/or outdated, your access to Hike Wallet Services or any part thereof may be suspended or terminated.

4. Transaction Confirmation And Transaction History
When your payment instructions are successfully processed with respect to a transaction, we will update your Hike Wallet transaction history and provide you with a transaction confirmation. This confirmation will serve as a receipt of the transaction. You acknowledge that we will only release the transaction confirmation upon receiving confirmation with respect to the authentication, authorization and processing of such transaction from the provider of the payment system. We will not be responsible or liable for any transactions that have not been confirmed to us by the providers of the payment system/instrument.
5. Risk Monitoring
You understand and acknowledge that we may monitor your transactions and processing activity for identifying any high-risk practices, security concerns or for fraudulent transactions. We may also engage third-party service providers to assist in these efforts and other elements of the Hike Wallet Services. If we believe there is a suspicious or unusual activity, we may temporarily or permanently suspend your access to Hike Wallet Services or any part thereof. Suspicious or unusual activity includes, but is not limited to changes in your average transaction amount or processing pattern or use of different payment accounts.
6. Prevention of Unauthorized Access and Security Procedures
Unauthorized access to your financial information:
In order to prevent unauthorized access to your sensitive personal information, you agree to:
a) maintain the security of the Hike Wallet Services provided to you by not sharing sensitive personal information such as passwords, MPIN etc., with others and restricting access to your account on your mobile device;
b) ensure that you enable authentication for access to your mobile device such as a pattern lock, password protection, etc. and not leave your mobile device unattended or unlocked; and
c) take responsibility for all activities that occur under your Hike account and accept all risks of unauthorized access. If you believe your password or devices has been lost or stolen, or if you suspect any suspicious or fraudulent activity, please immediately report this to us immediately at email@example.com.
Security Measures: In order to ensure safety of your personal information, we have engaged partners providing Payment Card Industry Data Security Standard (PCIDSS) and ISO 27001 certified services. We have implemented technical and organizational measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration or disclosure. However, we cannot guarantee that unauthorized third parties will never be able to defeat those measures or use your personal information for improper or illegal purposes. You acknowledge that you provide your personal information at your own risk.
7. Your Responsibilities
a) You agree and understand that when you purchase/avail any goods or services or make payment to a Merchant using Hike Wallet Services, we are not a party to the contract between you and the Merchant. We do not endorse any Merchant or the products or services offered by them. We are under no obligation to monitor the Merchant's service used by you and we shall not be responsible or liable for any deficiency or default in goods and/or services purchased using Hike Wallet Services. The Merchant alone will be responsible and liable for all obligations and you must resolve any dispute with or complaint directly with the Merchant. You are instructed to satisfy yourself regarding the quality, quantity and fitness of any good and/or service before purchasing the same.
Explanation: The term Merchant(s) shall mean sellers, retailers or e-commerce marketplace or such other organizations, establishments or business entities who accept Hike Wallet Services or any part thereof for the purpose of collecting payments from you. The terms Merchants shall include sellers offering products or services or collecting money through micro-applications on the Application.
b) You understand that payment instructions given using Hike Wallet Services are irrevocable. In the event that you transfer any amount erroneously to a Merchant or any other person using Hike Wallet Services, we shall not be liable to refund such amount to you under any circumstances.
c) The refund of any payment made shall depend completely upon the legitimacy of the dispute raised by you (as determined by hike) and us having/receiving sufficient funds of/from the Merchant in order to refund the transaction amount to you. Further, we shall in no way be liable for such refunds.
d) In the event of any dispute with respect to transactions carried out through Hike Wallet Services, Hike’s records shall be binding as the conclusive evidence of the transaction.
e) You will be solely responsible for payment of any taxes, charges, duties or other governmental levies or any financial charges that may be imposed on any products or services purchased using Hike Wallet Services.
f) You agree that you will not use Hike Wallet Services or any part thereof for any unlawful or illegal purpose. Your use of Hike Wallet Services shall at all times be in compliance with applicable laws including rules, regulations or directions issued by the Reserve Bank of India. In the event that you fail to comply with clause, we are entitled to temporarily or permanently suspend or terminate the Hike Wallet Services being provided to you or any part thereof.

Hike Wallet Issued by Airtel Payments Bank
The terms and conditions subject to which the Hike Wallet Services are provided are mentioned herein
(‘Terms and Conditions’).
The use of Hike Wallet Services by the Customer is subject to the acceptance of the Terms and
By enrolling for the Hike Wallet Services, the Customer acknowledges that the Customer has read, understood and agrees to be bound by these Terms and Conditions.
1.1 Airtel Payments Bank Limited (erstwhile known as Airtel MCommerce Services Ltd.) is a company incorporated under the Companies Act, 1956/2013 with its registered office at Bharti Crescent, 1, Nelson Mandela Road, Vasant Kunj, Phase II, New Delhi - 110070, India and Principal Office at Airtel Center, Plot No 16, Udyog Vihar, Phase-IV, Gurgaon-122015 (hereinafter referred to as the “Bank”).
1.2 “Hike Wallet Services” or “Services” refers to stored value digital wallet services offered by Airtel Payments Bank Limited vide the permission granted by Reserve Bank of India (‘RBI’). Bank issues Hike Wallet Account as part of its Services.
Hike Wallet Services are governed by:
(a) The Payment and Settlement Systems Act, 2007 & Regulations made there under,
(b) Policy Guidelines on Issuance and Operation of Pre-Paid Payment Instruments in India, 2016 ("RBI Guidelines") and
(c) Instructions issued by the RBI from time to time in respect of the same.
1.3 "Customer" shall mean an Indian National above 18 years of age and registered user of the Application and Services, to whom a Hike Wallet has been issued by the Bank.
1.4 “Access Channel” shall mean the method used by the Customer to access the Hike Wallet Account on the Application.
1.5 "Hike Wallet Account" shall mean the pre-paid payment instrument issued by the Bank including
Express Account (Minimum KYC) and Power Account (Full KYC).
1.6 "Charge(s)" or "Service Charge" shall mean the charges which the Hike may levy upon the
Customer in consideration for enrolling for the Hike Wallet Services.
1.7 “Wallet to Wallet Transfer" refers to a facility provided by the Bank whereby a Hike Wallet can transfer funds from a Hike Wallet to any other Hike Wallet Account issued by the Bank as per applicable laws
1.8 “Wallet to Bank Transfer” refers to a facility provided by the Bank whereby a Hike Wallet can transfer funds from a Hike Wallet to a savings account as per applicable laws.
1.9 "Merchant Establishment" shall mean and include physical merchants, remote merchants, electronic commerce merchants, mobile commerce merchants and/or any other merchants (including financial services) who have been authorized by Hike or the Bank to accept payment for goods or services using the Airtel Money Account.
1.10 "USSD" means Unstructured Supplementary Services Data and refers to a method of accessing and using the Hike Wallet Account, i.e. by dialing a specified short code from the mobile number registered with the Bank for Hike Wallet Services.
1.11 “Registration Form” shall mean the digital form to be completed in the Application by the Customer along with necessary supporting documents, as required by Hike or the Bank for enrolling for the Hike Wallet
1.12 “Express Account” shall mean a Hike Wallet Account classified as semi-closed system payment instrument issued by the Bank by accepting minimum Customer details.
1.13 "Power Account" shall mean a Hike Wallet Account classified as semi-closed system payment instrument issued by the Bank by accepting full KYC details prescribed vide RBI master directions and approved under the PML Rules 2005, as amended from time to time.
1.14 "KYC" stands for Know Your Customer and refers to the various norms, rules, laws and statutes issued by RBI from time to time under which the Bank is required to procure personal identification details and authorization for accessing/utilizing documents received by Bharti Airtel Ltd. from the Customer as may be required at the time of enrolling for Hike Wallet Services and/ or on a later date, for availing and / or continuation of the Hike Wallet Services.
1.15 "Transaction" shall mean an online payment made by a Customer to a merchant through the Hike Wallet; or to other Customers through Wallet to Wallet Transfer and shall include loading/reloading of the Hike Wallet.
2.1 All references to singular include plural and vice versa and the word "includes" should be construed as "without limitation".
2.2 Words importing any gender include the other gender.
2.3 Reference to any statute, ordinance or other law includes all regulations and other instruments and all consolidations, amendments, re-enactments or replacements for the time being in force.
2.4 All headings, bold typing and italics (if any) have been inserted for convenience of reference only and do not define limit or affect the meaning or interpretation of these Terms.
3.1. The collection, verification, audit and maintenance of correct and updated Customer information is a continuous process and the Bank reserves the right, at any time, to take steps necessary to ensure compliance with all relevant and applicable KYC requirements. The Bank reserves the right to discontinue services/ reject applications for Hike Wallet Services at any time if there are discrepancies in information and/or documentation provided by the Customer.
3.2. Any information provided to the Bank with the intention of securing Hike Wallet Services shall vest with the Bank, and may be used by the Bank, for any purpose consistent with any applicable law or regulation, at its discretion.
3.3. If the KYC details do not match with the particulars provided in the registration form, or the Bank has the right to close the account and may forfeit the balance therein.
3.4 For any information provided by the Customer to the Bank for any purpose, via any medium, Customer is solely responsible for the correctness of that information. If the information provided by Customer is found to be incorrect or erroneous, the Bank holds no responsibility and is not liable for any consequences that the information may carry. If the Customer finds out any information related to his/her account is incorrect or erroneous, he or she can reach out to the Bank to notify the same. If Hike or the Bank finds out that the information provided by Customer is false or erroneous, Bank holds the right to terminate the Customer’s account and forfeit the amount lying in the account.
4. GENERAL CONDITIONS OF HIKE WALLETSERVICE
4.1 Upon successful registration on the Application, Customer will be issued a Hike Wallet. The account can be upgraded to a Power Account on submission of required KYC details by the Customer when the same are verified and approved by the Bank after following the due process.
4.2 The Customer may credit the Hike wallet through any of the methods as per applicable law and at the discretion of Bank
4.3 The Customer may note that withdrawing cash from Hike Wallet Account is not allowed.
4.4 Hike Wallet Services are not transferable.
4.5 The maximum monetary value that can be stored at any point of time in an Hike Wallet Power Account is INR 1,00,000/-(Rupees One Lac Only).
4.6 The maximum monetary value that can be stored in a month in an Express Account is INR 10,000/- (Rupees Ten Thousand Only).
4.7 For transactions through USSD, the maximum permitted value of a single Transaction is INR
5,000 (Rupees Five Thousand Only).
4.8 These limitations stated in clauses 4.6, 4.7, 4.8 & 4.9, in line with the regulations, may be reviewed and modified at the discretion of the Bank without prior intimation to the Customer
4.9 Any value in the Customer’s Hike Wallet Power Account must be utilized within the validity period of 365 days from the date of last transaction or from the date of activation of the Hike Wallet Power Account; whichever is later
4.10 The Bank reserves the right to suspend/discontinue Hike Wallet Services at any time, for any cause, including, but not limited, to the following-
(a) For any suspected discrepancy in the particular(s), KYC details or Registration Form provided by the Customer;
(b) To combat potential fraud, sabotage, willful destruction, threat to national security or for
any other force majeure reasons etc;
(c) If the same is due to technical failure, modification, upgradation, variation, relocation, repair, and/or maintenance due to any emergency or for any technical reasons.
(d) If the same is due to any transmission deficiencies caused by topographical and geographical constraints/limitations;
(e) If the mobile connection with which the Hike Wallet Account is related, ceases to be
operational or in the Customer’s possession or control.
(f) For any suspected violation of the rules, regulations, orders, directions, notifications issued by RBI from time to time or for any violation of the Terms and Conditions mentioned in herein; (g) If the Bank believes, in its reasonable opinion, that cessation/ suspension is necessary.
4.11 The Bank may as per its discretion introduce appropriate controls including but not limited to revised Hike Wallet Account limits.
The Customer must utilize the value stored in the Hike Wallet Account to make payments for bona-fide Transactions.
4.12 The Customer is permitted to maintain and operate only one Hike Wallet Account. Any suspected non-conformity with this requirement shall be just cause for the suspension/ discontinuation of any/all Hike Wallet Accounts associated with the Customer by Hike or the Bank.
5. BILLING AND PAYMENT
5.1 The Customer shall pay any Service Charges in any form and manner prescribed for such payment. These charges may be, changed, amended, increased, modified or reduced from time to time with due notification to the Customer.
5.2 Any value in the Hike Wallet Account that is utilized towards making payments for any Transaction shall be automatically debited from the Hike Wallet Account. Bank's responsibility is limited to debiting of the Hike Wallet Account. Hike or the Bank does not endorse, promote, champion or warrant any goods and/or services that might be bought/availed or proposed to be bought/availed using the Hike Wallet Services.
5.3 Hike or The Bank reserves the right to recover funds for Transactions processed from the balance in the Customer’s Hike Wallet Account.
6. CUSTOMER OBLIGATIONS
6.1 Hike Wallet availability is subject to the maintenance of an active mobile phone connection with a telecommunications service provider and a mobile phone handset supporting Access Channels on which Hike Wallet runs. The Customer is solely responsible for all liability arising from the unavailability of the Hike Wallet services due to non-maintenance of an active mobile phone connection with the telecommunications service provider or a mobile handset not supporting the Access Channels.
6.2 The Customer must ensure the availability of sufficient funds before executing any Transaction from the Hike Wallet Account.
6.3 The Customer shall only use Hike Wallet Services for Transactions with the approved Merchant Establishment including financial services and Banks.
6.4 The Customer shall intimate Hike or the Bank about change in any information, including but not limited to change in address etc. within one week along with such proof of change as per the KYC documents and further provide any information and document that the Bank may request from time to time.
6.5 The Customer shall not use Hike Wallet Services for any purpose that might be construed as contrary or repugnant to any applicable law, regulation, guideline, judicial dicta, the Bank’s PPI policy or public policy or for any purpose that might negatively prejudice the goodwill Hike or of the Bank.
6.6 The Customer acknowledges and understands that Hike Wallet Services are linked to the mobile phone connection and the Customer shall be solely responsible for any liability arising out of the loss/ theft / misuse of the mobile phone number or deactivation of mobile connection by the telecommunications service provider.
6.8 Information submitted by the Customer for availing the Hike Wallet Services or information submitted while using Hike Wallet may be shared with third parties by Bank, inter alia, to facilitate the provision of Hike Wallet.
6.9 Information submitted by the Customer for availing the mobile connection of Bharti Airtel Limited or information submitted by the Customer while using the mobile connection of Bharti Airtel Limited, may be requested from Bharti Airtel Limited and used by the Bank to facilitate the provision of Hike Wallet Services with the consent of the Customer.
6.10 The Customer shall ensure that the Hike Wallet Services are not used for Transactions in foreign currency.
7.1 Privacy of communication is subject to the terms of the permission granted by the RBI and RBI notifications/directives etc. The Customers specifically agree that in order to facilitate the provision of Hike Wallet Services, the Bank may be required to disclose any information or particulars pertaining to the Customer to any authority, statutory or otherwise.
7.2 The user interfaces, graphics, logos, design, compilation, information, computer code (including source code and object code), products, software, services, and all other elements of the Hike Wallet Service provided by Hike or the Bank (the "Materials") are protected by copyright, designs, patent, and trademark laws, international conventions and other applicable intellectual property and proprietary rights of either Hike or the Bank and/or its related Parties.
8. DISCLAIMER OF LIABILITY
8.1 Hike or the Bank makes no express or implied warranty, guarantee, representation or undertaking whatsoever regarding the Hike Wallet Services, which are not expressly mentioned herein.
8.2 Hike or the Bank shall not be responsible for any acts or omissions of any third party including distributors/retailers/merchants etc., with regard to services which are not expressly authorized by the Bank.
8.3 Hike or the Bank shall not be liable to any person for any delays, loss of business, profit, revenue or goodwill, anticipated savings, damages, fees, costs, expense, etc. or for any indirect or consequential loss, howsoever arising, on Hike Wallet Account being unavailable/usage of the Hike Wallet Services or otherwise.
8.4 Hike or the Bank shall not be liable to any person for injuries or damages resulting from omissions, interruptions, delays, errors in transmission, failures or defects in equipment, or disconnection of the mobile services by any telecom service provider including Bharti Airtel Limited or any other cause including but not limited to the failure to transmit, or any other causes beyond the control of the Bank or for any reason whatsoever.
8.5 The Terms and Conditions herein shall be subject to the notifications/ guidelines issued by RBI, from time to time.
8.6 Hike or the Bank will do its best to ensure that Customer Transactions and information remain secure and confidential. Hike or The Bank makes no warranty or representation of any kind in relation to the system and the network or their function or performance or for any loss or damage whenever and howsoever suffered or incurred by the Customer or by any person resulting from or in connection with the use of the Hike Wallet Services.
9.1 The Customer agree to indemnify, defend and hold Hike, The Bank, and/or related parties harmless from any and all claims, losses, damages, and liabilities, costs and expenses, including and without limitation legal fees and expenses, arising out of or related to the use or misuse of the Hike Wallet Services, any violation of these Terms and Conditions, or any breach of the representations, warranties, and covenants.
10. ADDITIONAL T&Cs
10.1 Any dispute with or complaint against any Merchant Establishment including financial services or banks must be directly resolved by the Customer with the Merchant Establishment or financial services company or bank. It is clarified that the Bank shall not be responsible or liable for any deficiency in goods and/or services purchased using Hike Wallet Services. This exclusion of liability shall apply even for goods and/or services made available by Hike or the Bank under promotional schemes. The Customer is instructed to satisfy themselves regarding the quality, quantity and fitness of any good and/or service before purchasing the same.
10.2 Any amount transferred erroneously by the Customer to any Merchant Establishment including financial services or bank account shall not be refunded to the Customer by the Bank under any circumstances.
10.3 In the event of any dispute, the Bank records shall be binding as the conclusive evidence of the transactions carried out through use of Hike Wallet Services.
10.4 Hike or the Bank may send Customer communications by SMS and the SMS shall be deemed to have been received by the Customer after they have been submitted for delivery to the mobile phone operator. The Bank, at its own discretion, may also contact the Customer, for all purposes necessary for providing & improving the Hike Wallet Services
10.5 The Customer agrees to receive all commercial messages including transactional messages from the Bank or Hike.
10.6 By agreeing to the Terms and Conditions, user will authorize Bharti Airtel Ltd. to share his/her KYC details with Airtel Payments Bank for the purpose of creation of a Power Account
10.7 By agreeing to the Terms and Conditions, user agrees that the details mentioned in the KYC are to be considered as final details for Power Account
10.8 By agreeing to the Terms and Conditions, Bharti Airtel Customer agrees to Bharti Airtel sharing his/her Aadhaar number with Airtel Payments Bank once his/her Aadhaar number is linked with his/her Airtel mobile number to upgrade the Express Account to a Power Account.
11. CHANGE OF TERMS
11.1 Hike or the Bank have the discretion to change, add / or delete these Terms and Conditions.
11.2 Hike or the Bank may modify, terminate and/or suspend Hike Wallet Services to the Customer anytime with or without prior notice, due to any changes in internal policies, rules, regulations and laws set by relevant authorities/regulators.
11.3 Any amendment of these Terms and Conditions proposed by the Customer shall not be effective unless it shall be reduced to writing through an amendment form and accepted by Hike and the Bank. Amendments made under this clause shall be deemed to be a part of these Terms and Conditions and in case of any contradiction the amendment form accepted by the bank shall prevail.
11.4 Changed Terms and Conditions will be displayed within the Application. By continuing to use the Hike Wallet Service, the Customer will be deemed to have accepted the changed Terms and Conditions.
12.1 If any part of this Terms and Conditions is adjudged illegal or inoperable for any reason, the same shall be severed from the remainder of the Terms and Conditions and only that portion of this Terms and Conditions that is specifically adjudged illegal or inoperable shall cease to govern the relationship between Hike, the Bank and the Customer.
These Terms are governed by the laws of India. You irrevocably consent to the exclusive jurisdiction of courts at Delhi, India for all disputes arising out of or relating to these Terms.
14. DECLARATION BY CUSTOMER
I (“the Customer”) agree that the opening and maintenance of the wallet Account is subject to rules and regulations introduced or amended from time to time by the Reserve Bank of India. I hereby certify that I have declared my status as per the rules applicable under section 285BA of the Income Tax Act, 1961 as notified by Central Board of Direct Taxes (CBDT) vide Notification No. S.O. 2155(E) dated 7 August 2015 and RBI Circular Ref No. DBR.AML.BC.No.36/14.01.001/2015-16 dated 28 August 2015 in this regard. I understand and acknowledge that as per the provisions of Income Tax Act, Rules made there under and the guidelines issued by the RBI in the matter, depending upon the residential status and/or other criteria stipulated therein, the Bank may have to report the details in respect of wallet Account(s) as per the prescribed format to the Central Board of Direct Taxes (CBDT) or other Government Agencies to comply with the obligations as per the Inter-Governmental Agreements (IGA) in respect of Foreign Accounts Tax Compliance Act (FATCA) and Common Reporting Standards (CRS) and or any other similar arrangements.
i) I hereby declare that I am a citizen of the Republic of India and not of any other foreign country.
ii) I certify that the information provided by me above as applicable to me by me as well as in the documentary evidence provided by me are, to the best of my knowledge and belief, true, correct and complete and that I have not withheld any material information that may affect the assessment/categorization of my wallet Account as a U S Reportable Account or Other Reportable Account or otherwise. I undertake the responsibility to declare and disclose within 30 days from the date of change, any changes that may take place in the information provided by me, as well as in the documentary evidence provided by me or if any certification becomes incorrect and to provide fresh and valid self- certification along with documentary evidence.
iii) I also agree that my failure to disclose any material fact known to me, now or in future, may invalidate me from transacting in the wallet Account and the Bank would be within its right to put restrictions with respect to the operations of my wallet Account or close it or report to any regulator and/or any authority designated by the Government of India (GOI) /RBI for the purpose or take any other action as may be deemed appropriate by the Bank, under the guidelines issued by CBDT/RBI from time to time, if the deficiency is not remedied by me within the stipulated period.
iv) I also agree to furnish and intimate to the Bank any other particulars that are called upon me to provide on wallet Account of any change in law either in India or abroad in the subject matter herein.
v) I agree to abide by the Bank's Terms and Conditions and rules in force and the changes thereto in T&Cs from time to time relating to my Account as communicated and made available on the Bank's website.

By opting to send a Blue Packet you pre-authorize Hike to block such amount that you are desirous of transferring to another user(s) from/in your Hike Wallet Issued by Airtel Payments Bank. Accordingly, once you send a Blue Packet either to a single of a group of recipient(s), an amount corresponding to the value of the Blue Packet sent by you will be blocked in your Hike Wallet Issued by Airtel Payments banks. This amount shall get debited from your Hike Wallet Issued by Airtel Payments banks and credited to the Hike Wallet Issued by Airtel Payments Bank of the recipient(s) only upon acceptance of the Blue Packet by the recipient(s).
Explanation: Clicking of the Blue Packet in the chat thread by the recipient(s) (either in personal chat or group chat) amounts to acceptance.
Unified Payment Interface Service Terms
The Application is a UPI compliant application, which may be used for transfer of money from your UPI enabled bank account to another UPI enabled bank account. Transfer of money through UPI may either be in the form of person-to-person money transfers or payments owed to Merchants.
The following words and phrases shall have the meanings set out herein below:
"Authentication Credentials" shall mean password, biometrics, PIN etc., as provided by the PSP or 3rd party provider like UIDAI, from time to time, which shall be required by the Customer for completion of the transfer of funds through UPI.
"Beneficiary Bank" shall mean the bank holding a bank account of the Receiver where the credit of the UPI instruction is received from the Payer to be executed either in real time basis or periodically with a settlement process.
"Customers" shall be used to collectively refer to Payer(s) and Receiver(s) using UPI Services enabled on the Application for initiating and executing Transactions.
"NPCI" shall mean the National Payments Corporation of India, a company incorporated under Section 25 of the Companies Act, 1956 and having its registered office at 1001A, B wing 10th Floor, The Capital, Plot 70, Block G, Bandra- Kurla Complex, Bandra (East), Mumbai - 400 051, and acting as the settlement, clearing house and regulating agency for UPI Services.
"Payer" shall mean any person holding a banking account and who desires to pay money to the Receiver for purchase of goods or services online using the UPI Services, being offered by the PSP through the Application.
"Payment Service Provider" or "PSP" shall mean an entity, which is allowed to issue virtual addresses to the customers and provide payment (credit/debit) services to individuals or entities and regulated by the Reserve Bank of India, in accordance with the Payments and Settlement Systems Act, 2007. Yes Bank acts as PSP for provision of UPI Services on the Application.
"UPI Services" shall mean the inter-bank fund transfer services being provided by the NPCI through the Unified Payment Interface, a multi-platform operable payment network solution. UPI enables push and pull based payments, i.e., payment to other users and collection of payment from other users in accordance with rules, regulations and guidelines issued by NPCI and the Reserve Bank of India from time to time.
"Virtual Address" or "VPA" means a unique Payment Identifier issued by a PSP to a Payer or a Receiver that, among other things, can be used to identify a bank account.
"Yes Bank Limited" or "Yes Bank" or "Bank" shall mean Yes Bank Limited a company within the meaning of the Companies Act, 1956 and a banking company within the meaning of Section 5(c) of the Banking Regulation Act, 1949 having its registered office at 9th floor, Discovery of India Building, Nehru Centre, Dr. Annie Besant Road, Worli, Mumbai – 400018.
"Receiver" shall mean any person or the Merchant holding a banking account, who is desirous to receive payments from the Payer over the Internet using the UPI Services. In case the Payer is Customer of the Merchant and is paying money to the Merchant for purchase or utilization of goods and services from the Merchant, the Merchant shall be the Receiver.
"Transaction" shall mean every payment instruction that results in a debit to the Payer’s bank account and a corresponding credit to the Receiver’s bank account.
2. Scope of UPI Services
a) The Customer understands that: (i) the Customer’s personal mobile phone shall be used as the primary device for all transfer of funds made UPI Services including person to person, person to entity, and entity to person; (ii) UPI Services may require the Customer to provide information including but not limited to Aadhaar number, mobile number, card number, and account number; (iii) enable the Customer to make payments only by providing the Receiver’s VPA or phone number; (iv) the Customer may send pull or collect requests to other Customers (person to person or entity to person) with "pay by" date to allow payment requests to be “snoozed” and paid later before expiry date, until Customer is ready to pay, without having to block the money in the Customer’s bank account; (v) UPI Services may be used to pre-authorize multiple recurring payments with a one-time secure authentication and rule based access.
b) The Customer undertakes to execute such documents and in such form or manner as may be required by the PSP from time to time, for the purpose of activating, initiating or making transfer of funds via UPI Services.
c) The Customer understands and agrees that all instructions given by the Customer through the UPI Services shall be irrevocable in nature. Hike and the PSP shall be bound to act upon all instructions given by the Customer for transfer of funds using UPI Services upon confirmation of the Authentication Credentials. The PSP may, in its sole and absolute discretion and without requirement of any notice or reason whatsoever, revoke or cancel any instructions issued by the Customer and such decision of of the PSP shall be final and binding on the Customer.
d) All transactions shall be confirmed by a 1-click 2-factor authentication on personal phone of the Customer, without having any acquiring devices or having any physical tokens.
e) The Customer understands and agrees that the Transaction(s) shall be acted upon by the PSP through UPI Services, on the date of the instruction given by the Customer.
f) The Customer understands and acknowledges that a Transaction may be rejected or cancelled in case the instructions and/or any Authentication Credentials or any details, documents or information provided by the Customer are false or not in accordance with the conditions stipulated by the PSP, the NPCI, the Reserve Bank of India or the Beneficiary Bank. The Customer agrees that a Transaction may also be cancelled/rejected due to reasons such as "the designated account of Receiver/beneficiary not being maintained by the Beneficiary Bank” or “an attachment order having been passed by a competent authority/Court with respect to the designated Receiver/beneficiary account” or “details pertaining to the Receiver/beneficiary account details recorded with the Beneficiary Bank do not match” or any other such reasons.
g) The Customer ensures and confirms that upon completion of the transaction initiated by the Customer, i.e., receipt of funds by the Receiver, Hike and the PSP will be entitled to charge such fees, cost and charges, as specified by Hike and the PSP, from time to time, save and except, where such imposition of charge is restricted by law. Without prejudice to any other rights of recovery that the PSP may have, the PSP shall be entitled to debit any of the Customer's accounts held with the PSP for any such fees, charge or costs.
h) The Customer acknowledges and understands that the completion of transactions for transfer of funds based on the Customer's instruction shall involve various counterparties. The Customer confirms that Hike or the PSP shall not be held liable or responsible for any delays/deficiencies in settlement of a transaction due to system constraints, actions of 3rd parties or any other circumstances outside the control of Hike or the PSP. Without prejudice to the generality of the foregoing, the Customer agrees to indemnify and save, keep harmless and keep indemnified Hike and the PSP against any improper/ fraudulent instructions purporting to be received from the Customer and/or for furnishing incomplete information.
i) The Customer understands that the provision of UPI Services is subject to applicable laws and the guidelines, rules and regulations issued from time to time by the NCPI or Reserve Bank of India.
j) The Customer understands that the NCPI in this regard shall be an intermediary/ a service provider in the process of settlement of a Transaction initiated using UPI Services, subject to the availability of sufficient funds in the account of the Customer. Any transaction initiated by the Customer shall be deemed to be complete in all respects if a decline message is not received by the Customer from the PSP within a reasonable period time (decision of the PSP in this regard shall be final and binding). Transactions shall be deemed to be settled at the time when the account of the Customer has been debited and the account of the Receiver maintained with the Beneficiary Bank has been credited.
k) The Customer understands that the PSP may amend the above terms and conditions, at any time without any notice or assigning any reason whatsoever and such amended terms and conditions will thereupon apply to and be binding on the Customer.
l) The Customer agrees and confirms that the minimum and maximum amount that may be transmitted using UPI Services shall be stipulated by the PSP in accordance with applicable laws and the guidelines set by NPCI or RBI, from time to time.
Reward Programme Terms
Hike may from time to issue various offers through the Hike App. By successfully completing the steps for each Offer you can claim the Reward(s) applicable for that Offer.
The reward is an amount (determined by Hike) transferred to your Hike Wallet Issued by Airtel Payments banks (“Rewards”) on successful completion the steps required for that Offer.
If you receive any of the following Offers, you can claim a Reward by completing the Steps prescribed given below:
In this Offer you can claim the Reward by sending a Blue Packet to a group chat thread.
Steps to avail the Offer 1:
a. Within 24 hours of receiving the Offer, send a minimum of Re.1 through a Blue Packet to a group chat thread of your choice; and
b. click on link send to claim the Reward, within 24 hours of sending the Blue Packet to a group chat thread.On successfully completing the above steps, a Reward will be credited to your Hike Wallet Issued by Airtel Payments banks. Notes: If a Blue Packet is not successfully delivered to the group chat thread, you cannot claim the Reward. a. Click on the Blue Packet within 24 hours of receiving it in your chat thread with Natasha*.
b. Click on the "Send Blue Packet" button and share it in any group chat thread. 2. General Terms and Conditions applicable to Reward Programme
a) Hike may at it’s sole discretion and as per the eligibility criteria identified by it choose to send any of the Offer(s) to a select number of users. You have no claim against Hike if you do not receive any of the Offer(s).
b) To avail the Offer(s), you must have a valid and verifiable Hike Wallet Issued by Airtel Payments banks.
c) The Reward will only be credited to your Hike Wallet Issued by Airtel Payments banks.
d) An Offer can be availed only by the intended recipient and cannot be onward sent, distributed, transferred or sold. However, once you successfully claim the Reward, the amount transferred to your Hike Wallet Issued by Airtel Payments banks, can be used/transferred/spent in any manner permitted under these terms and conditions and applicable law.
e) You can avail a single Offer only once. Hike may choose to send you multiple Offers, however each Offer can be availed only once.
f) You can avail an Offer only if you have the Hike Android App version 5.0 or above.
g) Hike reserves the right to discontinue or modify the terms and conditions of the Reward Programme without any prior notice.
h) You will not receive the Reward (even after successfully claiming it) if the transfer results in exceeding the maximum monetary limit of your Hike Wallet Issued by Airtel Payments banks. In this case, the entire Reward Amount will be credited to your Hike Wallet Issued by Airtel Payments banks in the succeeding month. All transfers to will be subject to extant RBI Guidelines.
i) Please follow the complaint redressal process mentioned above with regard any complaint under Reward Programme.
j) Hike reserves the right to suspend or revoke the eligibility of any user to claim a Reward, if it observes any suspicious or potentially fraudulent activity.
k) Unless otherwise mentioned here, all other terms and conditions applicable to the Hike Wallet Issued by Airtel Payments banks will be applicable to the Reward Programme.
Bae – Buddy – Bro Program
3. In order to participate in the Program, you will provide Hike with your profile information which includes your name, age, gender, profile picture and any other information ("Program Profile Information"). Hike may use profile information from the Hike Messenger Application which includes your name, profile picture, age, gender (“Messenger Profile Information”) to populate your Program Profile Information.
4. By participating in the Program, you agree and understand that other users will be able to view (a) your Program Profile Information; (b) the Messenger Profile Information (or any part of it) of contacts on your devices phone book (who have agreed to the Hike Terms); and (c) information regarding contacts in your device’s phone book. You must be authorised by your contacts to display their information in the Program. We assure you that other members will be able to view your or your contacts phone numbers (through the Program) only once they are matched.
5. You guarantee that any information and other content, such as your Program Profile Information and information regarding the contacts contained in your device’s phone book, that you may share with Hike, to the best of Your knowledge, is correct, not in violation of applicable law, and that you have the right to share such content with Hike in order for Hike to operate the Program.
6. As part of the Program, you will be shown Program Profile Information (or certain portions of it) of other users on a random basis via computer-generated mechanism. You may choose to categorise users as ‘Bae’, ‘Bro’ or ‘Buddy’ ("Select") or discard any user’s Profile Information. If two users Select each other in same category, the Program will match them. For instance, if two users Select each other in the ‘Bro’ category then they will be matched. However, if one user Selects the ‘Bro’ category while the other Selects a ‘Bae’ category then no match is created between these two users.
7. Unlocking matches- You can unlock your matches and connect with them, in the following manner: a. Your ‘Buddy’ matches: On August 6, 2017 (Friendship Day) all your Buddy matches will be automatically unlocked; b. Your ‘Bro’ matches: On August 7, 2017 (Rakshabandhan Day) all your Bro matches will be automatically unlocked; and c. Your ‘Bae’ matches: You can unlock you Bae matches at anytime after August 8, 2017 by sending or on receipt of a Blue Packet (of any value) by such user [see Blue Packet T&C insert link]. Note that to unlock each match you need to send or receive a Blue Packet (of any value) to or from such user.
In certain cases, Hike may also send you free Blue Packets to share with your matches. The amount being transferred to the recipients Hike Wallet Issued by Airtel Payments banks through such free Blue Packets will be determined by Hike at its sole discretion.
8. Once matches are unlocked, users can communicate with each other through the Hike Messenger Application. Once a match is unlocked both users will be able to view each other’s phone numbers.
9. While using the Program, we urge you to observe the following precautions (a) be cautious while sharing personal information addresses; (b) refrain from sharing sensitive information like bank account and credit card information; and (c) beware of fake profiles.
10. You can disable the Program and opted out of the Program. Post which your Program Profile Information shall not be displayed to any other users.
11. You undertake that Hike does not have any direct or indirect control over your choices pertaining to any user’s Program Profile Information. Further you agree and acknowledge that Hike will not be responsible or liable in any manner whatsoever for the kind of anonymous users matched with you and/or the contents of chat messages exchanged or other dealings of whatever nature that take place between you and any user matched with you. Hike does not conduct criminal background checks or screening of the users nor does it verify any information including Program Profile Information provided by the user. Hike does not make any representations or warranties as to the conduct of the users or their compatibility with any current or future users.
12. The Program is for personal use only. Users may not use the Program or any content contained in the Program (including, but not limited to, content of other users, designs, text, graphics, images, video, information, logos, software, audio files and computer code) in connection with any commercial endeavours, such as (i) advertising or soliciting any user to buy or sell any products or services not offered by Hike or (ii) soliciting others to attend parties or other social functions, or networking, for commercial purposes. Users may not use any information obtained from the Program to contact, advertise to, solicit, or sell to any other user. Organizations, companies, and/or businesses may not use the Program for any purpose.
13. By participating in the Program, you agree and acknowledge that Hike will not be responsible or liable for any loss or damage whatsoever whether, direct, indirect, general, special, compensatory, consequential or incidental suffered by you on account of your participation in the Program.
15. Hike reserves the right to investigate into your activities pertaining to the Program and terminate your usage of the Program at its sole discretion.
16. Hike provides the Program on an "AS IS" and "AS AVAILABLE" basis and grants no warranties of any kind, whether express, implied, statutory or otherwise with respect to your use of the Program (including all content contained therein), including any implied warranties of satisfactory quality, merchantability, fitness for a particular purpose or non-infringement. Hike does not represent or warrant that your use or access to the Program will be uninterrupted, error free or secure.
17. Hike makes no representations or warranties as to the conduct of the users or your compatibility with any current or future users you connect with through the Program. You agree to take all necessary precautions in all interactions with such users, particularly if you decide to communicate off the Program or Hike Messenger Application or meet in person.
By signing into the 'Hike Confessions' feature you agree to the following terms and conditions:
1. Other users can find you by searching for your name/username and send you anonymous messages.
2. You can choose to 'block' users, after which they will not be able to send you messages through the 'Hike Confessions' feature.
3. Hike may introduce features which allow you to request the sender to 'reveal their identity'. If the sender accepts this request, both you and the sender will be able to view each other's profile information, including phone number's.
4. Hike may also introduce features which allow you to you join a 'college group'. You may receive and send anonymous messages to members of that group. Please note, Hike does not make any background checks about members and makes no guarantee that members of a college group have any connection with or are students of the selected college.
5. Hike is not responsible for the contents of chat messages exchanged or other dealings of whatever nature that take place between you and any user.
6. Hike does not conduct criminal background checks or screening of the users nor does it verify any information about the user.
7. Do not use this feature to bully, abuse, intimidate, insult or harass others. Hike reserves the right to disable usage of this feature either temporarily or permanently if we consider your usage disruptive in any way.
a) Through the ‘Hike Rewards’ feature, Hike may issue certain tasks/offers from time to time giving you the opportunity to earn rewards in your Hike Wallet. You agree that by participating in the tasks you will be bound by these Terms and Conditions.
b) In order to offer and curate the Tasks for you, Hike requires you give it the ‘Accessibility’ permission from your phone settings. We need this permission to view your device activity, including the data displayed on your device in order to offer you various ‘tasks’ giving you the opportunity to win rewards. You can withdraw such consent at any time by revoking the Accessibility permission from your phone settings.
c) You or any group member can choose to import the group chat (including chats, photos, videos) (“Group Chat”) from other messaging applications by clicking on the ‘Import’ button in the group chat thread on the Hike Application.
d) Please ensure you have been authorized by other members of any group you try to import to transfer the Group Chat to Hike. Hike will in no way be responsible for any claims, actions, suits, from other users or any third party for transfer of the Group Chat from other messaging applications to Hike. In case of any such action, you agree to hold Hike harmless on account of any penalty, loss, damages incurred by Hike.
e) All rewards will be credited to your Hike Wallet issued by Airtel Payments Bank. The amount of reward can vary for each user and each individual task, and will be determined by Hike at its sole discretion. Claiming rewards is subject to the reward programme terms of Hike [Link to old reward T&C within overall Hike T&C].
f) One user can get a maximum aggregate reward of Rs. 10,000 for all Hike Challenges.
g) The amount of reward will be determined by Hike.
h) Any dispute in relation to grant of reward will be decided by Hike at its sole discretion.
i) Hike may at its sole discretion discontinue or alter the terms and conditions applicable to the Hike Rewards feature.
j) All other Hike T&C will apply. In case of any conflict between the general T&C and these terms, with regard the ‘Hike Rewards’ feature, these terms will apply.
Terms of the Hike Rewards Tasks
Invite Groups Task
Hike will provide you with the option to invite groups from other messaging applications to Hike.
By clicking on the ‘Invite’ button, a group with same members (as on other messaging applications) will be created on Hike. All existing Hike users will be added to the group. You can remind non-Hike users to join the Hike Application by clicking on the ‘Remind’ button. By clicking on the Invite/Remind button we will send a message on your behalf through the chosen messaging application, inviting/reminding participants to download the Hike Application.
Once the number of members specified by Hike have downloaded and opened an account with Hike, you will be entitled to claim your reward.
Hike will at its sole discretion decide the minimum number of group members which needs to download and register an account with Hike, for you to claim your reward.
The amount of reward may vary depending on the group(s) you choose to invite to Hike and on the number of group members creating an account with Hike. Such amount of reward will be solely determined by Hike.
Invite Friends Task:
Earn rewards by sending invitation to your friends through other messaging applications. Hike will send an invite message on your behalf to the contacts chosen by you. The message will sent through other messaging applications on your device.
You will be entitled to claim you reward once the intended recipient has downloaded and created an account on the Hike Application.
Invite Friends via SMS Task:
Earn rewards by sending SMS invites to join Hike to your phone contacts.
You will be entitled to claim your reward once the intended recipient has downloaded and created an account on the Hike Application.
Earn rewards by completing all assigned tasks - inviting groups and contacts through other messaging applications and SMS etc.
The groups and phone contacts to which invitation will be sent through SMS and on the chosen messaging application, will be selected and predetermined by Hike.
You will be entitled to claim your reward once the intended recipient(s) has downloaded and created an account on the Hike Application.
hike may obtain the following types of information from or concerning You or Your mobile device, which may include personal information that can be used to identify You as specified below:
"last seen" information is available and displayed to each user whom you have added in your Friends (and which you have not blocked), and reﬂects the last approximate time the hike application has been backgrounded or brought to the foreground on your mobile phone. "Last Seen" information is reported to hike when a user brings the mobile application to the foreground or quits it.
Hike may receive data whenever You connect with an application through hike (such as during status update, when You connect to other sites/applications and in which case hike posts to these sites/applications on Your behalf ). This may include date and time You use the application, the web address, IP address information, browser and if You are logged into hike and Your authentication tokens used on such sites. Your authentication tokens may be saved on the server for the sole purpose of seamless posting to the same site by You in the future through the Application.
Hike does not collect emails, addresses or other contact information from its users’ mobile address book other than mobile phone numbers and names associated with such mobile phone numbers of the persons in such user’s contact lists and/or address books. The Application will associate whatever name the hike user has assigned to the mobile telephone number in his/her mobile address book. We may collect location data for use in the improvement of Services and users may also voluntarily share their location with other users via the Application.
Service Usage and Transactional Information: For enabling you to make payments using our Services, we may, upon your consent, store your financial information such as your bank account or details mentioned on your credit cards or debit cards, or other payment instrument details etc. that are required for a successful transaction. Further, for certain Services, including our bill payment service, we require your bill payment account information such as your account number, payment history, your account history with us etc. We also store transaction details such as amount spent, merchant name, transaction ID, date and time of transaction, of your e-commerce transactions. Further, we may also store information relating to your income and lifestyle levels. We clarify that all sensitive personal information or data is stored with third parties that PCI DSS certified.
If the recipient can be messaged via the Application, the message is delivered to that recipient via data service routed through our servers. Any messages that are undelivered are held on the hike servers until they can be delivered or for a period of 30 days whichever is earlier. Messages and files that are sent through the Service temporarily reside on our servers for a short period of time until delivery of such messages or files to the intended recipient is complete. We may use third party servers having industry standard security measures to provide you the Services.
Any status update messages, stories and profile image updates posted by you is stored on our servers to facilitate the normal use of the status updates feature in hike. This includes but is not limited to the timestamp and the actual status update message.
Hike may retain date and time stamp information associated with successfully delivered messages, the mobile phone numbers involved in the messages and any other meta-data associated with your use of our Services as well as any other information which hike is legally compelled to collect in accordance with retention policies applicable under Indian law.
Use of Information We do not sell Your Personally Identifiable Information that we collect with any third parties for use for commercial, advertising and or similar marketing purposes without your consent.

We will cooperate with the appropriate law enforcement authorities in investigating claims of illegal activity.
In the interest of protecting Your privacy and for security measures, Hike ensures to take reasonable steps to identify and authorise You before registering Your mobile phone number and granting You use of the Hike application.
Upon use of the Application or the Services, you authorize us to contact you regarding any promotions / notifications pertaining to Hike Application, notwithstanding that your number may be registered in the respective Do not Call Registry in your jurisdiction.
Security of Personal Information
We have implemented commercially reasonable physical, managerial, operational and technical security measures to protect the loss, misuse and alteration and to preserve the security of the Personally Identifiable Information in our care. Our security practices and procedures limit access to personal information on need to know basis only.
Such measures may include, where appropriate, the use of firewalls, secure server facilities, implementing proper access rights management systems and processes, careful selection of processors, standard authentication and encryption policies for our servers and other technically and commercially reasonable measures.
However, Hike cannot guarantee in any way with respect to any Personally Identifiable Information or Contents that You upload transmit, share or display through the Application, the Services and You do so at Your own risk.
Using unsecured or other unprotected networks to send messages and use of other features through the hike application is not recommended.
